Our experienced litigation team has built the strength and capability to rise to the challenges of fast-changing litigation in Romania. In recent years we have developed our litigation practice to provide a full and comprehensive service.

RTPR litigation practice focuses on fields such as competition law, intellectual property, information technology, tax and administrative litigation, energy law, insurance law, corporate law, disputes arising from mergers and acquisitions or financings, insolvency, national and international arbitration, corporate investigations, or labour law litigation. The added value that our Disputes & Investigations team brings to clients is the specialisation in certain niche areas, which pose significant legal risks for a company’s activity. This way of working requires in-depth knowledge and practical experience in the respective subject matter and involvement in assisting the client from the earliest moments of a sensitive situation, which could become litigious, often as part of multidisciplinary teams.

We have extensive experience in national litigation covering all types of commercial and business-related disputes. We also assist clients in international and European law procedures, including referrals to the European Court of Justice. We offer our clients a clear view upon the tactical and procedural avenues open to them before initiating any type of judicial proceeding and we make every endeavour to ensure that our clients’ interest is well-protected during the entire course of the litigation.

Transactions

Profi Rom Food in court proceedings against the decision of the Romanian Competition Council fining a vertical price fixing agreement. The fine has been irrevocably reduced by the High Court of Cassation and Justice with 75%.
Successfully contributed to the creation of EU law by obtaining a ground-breaking ruling from the highest EU court to the benefit of our client, Zenith (Publicis Group). Our team obtained a favourable ruling from the CJUE, which will have a significant cross-jurisdiction impact upon how the turnover will be calculated from now on by competition authorities across EU for the purpose of setting antitrust fines
Successfully represented Groupama Asigurari in the antitrust litigation against the decision issued by the competition authority in a complex antitrust investigation concerning a potential exchange of commercially sensitive information among the insurance companies in Romania. We obtained a significant reduction of the fine with approximately 95%. The case also triggered a preliminary question before the CJUE which is likely to create a landmark ruling for all EU jurisdictions.
Successfully represented Regina Maria in a series of complex cases initiated against its close competitor on grounds of unfair competition through social media tools, corroborated with copyright and trademark infringement, as well as false advertising. The case opens interesting legal debates on assessing brand value and proving dishonest intent in commercial practices between close competitors on niche markets and sets a new enforcement trend in light of the realities of the digital era.

Successfully represented RBS Bank Romania in an ICC arbitration held in Vienna, in relation to a contractual dispute
Successfully represented the most important Hollywood studios, including Paramount Pictures Corporation, Sony Pictures Entertainment, Twentieth Century Fox Film Corporation, Universal City Studios Productions, Walt Disney Studios Motion Pictures, and Warner Bros. Entertainment, in the first site blocking case which has ever been tried in CEE, by suing internet service providers with the aim of blocking pirate movies websites
A giant international tech group on all antitrust, investigative, and litigious aspects of a groundbreaking case regarding disputed tenders in the IT sector with a total value exceeding EUR 600 million
Successfully represented Electrica in an EUR 800 million litigation case against the Romanian Management Company for Ownership in Energy (SAPE) for alleged breaches of the post-privatisation monitoring obligations regarding former distribution subsidiaries of Electrica
