(1) litera (c) din Codul Muncii care interzice concedierea salariatelor \u00eens\u0103rcinate. De\u0219i Curtea Constitu\u021bional\u0103 a Rom\u00e2niei conchide c\u0103 prevederile de mai sus nu \u00eencalc\u0103 Constitu\u021bia Rom\u00e2niei, clarific\u0103 faptul c\u0103 <strong><span style=\"color: #b23400;\">un angajator are dreptul s\u0103 concedieze pe oricare dintre salariatele sale \u00eens\u0103rcinate pentru motive care nu au leg\u0103tur\u0103 cu starea de graviditate a acestora<\/span><\/strong>.<\/p><p>\u00cen timp ce Ordonan\u021ba de Urgen\u021b\u0103 a Guvernului nr. 96\/2003<a href=\"#_ftn2\" name=\"_ftnref2\">[2]<\/a> privind protec\u021bia maternit\u0103\u021bii la locurile de munc\u0103 prevede \u00een mod expres c\u0103 un angajator nu are dreptul s\u0103 \u00ee\u0219i concedieze salariatele \u00eens\u0103rcinate <strong>din motive care au leg\u0103tur\u0103 direct\u0103 cu starea acestora<\/strong>, prevederile din Codul Muncii nu sunt la fel de clare (i.e., Codul Muncii nu face nicio distinc\u021bie, ci prevede doar c\u0103 salariata \u00eens\u0103rcinat\u0103 nu poate fie concediat\u0103). Prin urmare, aceste dou\u0103 acte normative au creat multiple controverse.<\/p><p><span style=\"color: #b23400;\"><strong><em>C\u00e2nd poate un angajator s\u0103 concedieze o salariat\u0103 \u00eens\u0103rcinat\u0103?<\/em><\/strong><\/span><\/p><p>Analiz\u00e2nd constitu\u021bionalitatea art. 60 alin. (1) litera (c) din Codul Muncii, Curtea Constitu\u021bional\u0103 a Rom\u00e2niei a dispus urm\u0103toarele:<\/p><ul><li>toate prevederile legale referitoare la protec\u021bia maternit\u0103\u021bii trebuie interpretate \u00een ansamblu, iar lipsa clarit\u0103\u021bii art. 60 alin. (1) litera (c) din Codul Muncii nu trebuie interpretat\u0103 \u00een sensul \u00een care se opune unui concedieri pentru motive disciplinare; \u0219i<\/li><li>interzicerea concedierii unei salariate \u00eens\u0103rcinate <em>este strict circumscris\u0103 la motive care au leg\u0103tur\u0103 direct\u0103 cu starea acesteia, iar nu \u00een ceea ce prive\u0219te celelalte cazuri \u00een care \u00eencetarea contractului individual de munc\u0103 este urmarea unor abateri disciplinare, abateri grave, absen\u021bei nemotivate de la locul de munc\u0103, nerespect\u0103rii disciplinei muncii \u00een general, motive economice sau a unor concedieri colective<\/em>.<\/li><\/ul><p>Prin urmare, o astfel de decizie de concediere pentru motive care nu sunt legate de starea de graviditate a salariatelor este valabil\u0103, cu condi\u021bia ca angajatorul s\u0103 se bazeze pe unul dintre motivele legale de concediere. Numai \u00een cazul \u00een care o decizie de concediere este luat\u0103 pentru motive care \u00een esen\u021b\u0103 au leg\u0103tur\u0103 cu starea de graviditate a salariatei, angajatorul \u00eencalc\u0103 interdic\u021bia de concediere prev\u0103zut\u0103 la art. 60 alin. (1) litera (c) din Codul Muncii \u0219i decizia de concediere poate fi invalidat\u0103.<\/p><p><a href=\"#_ftnref1\" name=\"_ftn1\">[1]<\/a> Decizia nr. 1 din data de 14 ianuarie 2020, publicat\u0103 \u00een Monitorul Oficial nr. 232 din data de 21 martie 2020.<\/p><p><a href=\"#_ftnref2\" name=\"_ftn2\">[2]<\/a> Publicat\u0103 \u00een Monitorul Oficial nr. 750 din data de 27 octombrie 2003.<\/p><p>\u00a0<\/p><p><em>*Aceast\u0103 ePublica\u021bie este furnizat\u0103 de Radu T\u0103r\u0103cil\u0103 P\u0103durari Retevoescu SCA \u00een scop exclusiv de informare \u0219i nu reprezint\u0103 asisten\u021b\u0103 juridic\u0103 sau o ofert\u0103 pentru acordarea de asisten\u021b\u0103 juridic\u0103.
