Legea M\u0103surilor \u00een Starea de Alert\u0103 a intrat \u00een vigoare \u00een data de 18 mai 2020.<\/p><p>Starea de alert\u0103 a fost implementat\u0103 pentru o perioad\u0103 de 30 zile prin Hot\u0103r\u00e2rea nr. 24 din 14 mai 2020 a Comitetului Na\u021bional pentru Situa\u021bii de Urgen\u021b\u0103.<\/p><p>Legea M\u0103surilor \u00een Starea de Alert\u0103 implementeaz\u0103 m\u0103suri \u0219i restric\u021bii cu privire la diverse domenii, inclusiv insolven\u021ba, ce au ap\u0103rut ca o necesitate \u00een contextul impactului negativ al pandemiei asupra economiei \u0219i \u00eendeosebi asupra \u00eentreprinderilor mici \u0219i mijlocii. Expunerea de motive a proiectului de lege prevede faptul c\u0103 m\u0103suri similare au fost adoptate \u0219i de alte State Membre UE, precum Germania, Fran\u021ba, Lituania ori Estonia.<\/p><p>Cele mai importante modific\u0103ri aduse de Legea M\u0103surilor \u00een Starea de Alert\u0103 Legii nr. 85 din 25 iunie 2014 privind procedurile de prevenire a insolven\u021bei \u0219i de insolven\u021b\u0103 (<strong>Legea Insolven\u021bei<\/strong>) se refer\u0103 la:<\/p><ul><li>Pe durata st\u0103rii de alert\u0103, debitorul aflat \u00een stare de insolven\u021b\u0103 are dreptul, <span style=\"color: #b23400;\"><strong>\u00eens\u0103 nu \u0219i obliga\u021bia<\/strong><\/span>, de a formula cerere pentru deschiderea procedurii de insolven\u021b\u0103; termenul de 30 de zile \u00een interiorul c\u0103ruia debitorul are obliga\u021bia legal\u0103 de a formula cererea de deschidere a procedurii de insolven\u021b\u0103 va \u00eencepe s\u0103 curg\u0103 de la data \u00eencet\u0103rii st\u0103rii de alert\u0103 (fa\u021b\u0103 de data apari\u021biei st\u0103rii de insolven\u021b\u0103, astfel cum prevede Legea Insolven\u021bei).<\/li><li>\u00cen cazul \u00een care debitorul aflat \u00een stare de insolven\u021b\u0103 \u0219i-a \u00eentrerupt par\u021bial ori total activitatea ca urmare a m\u0103surilor adoptate pe durata st\u0103rii de urgen\u021b\u0103\/st\u0103rii de alert\u0103:<ul><li>Valoarea-prag (i.e. cuantumul minim al crean\u021belor ce declan\u0219eaz\u0103 obliga\u021bia de a formula cerere de deschidere a procedurii de insolven\u021b\u0103) a fost crescut\u0103 de la 40.000 RON (aprox. 8.300 EUR) la <span style=\"color: #b23400;\"><strong>50.000 RON<\/strong><\/span> (aprox. 10.400 EUR).<\/li><li>Creditorii care doresc s\u0103 formuleze o cerere de deschidere a procedurii de insolven\u021b\u0103 trebuie ca \u00een prealabil s\u0103 \u00eencerce, de o manier\u0103 rezonabil\u0103, s\u0103 negocieze cu debitorul \u00een vederea \u00eencheierii unei conven\u021bii de plat\u0103.<\/li><\/ul><\/li><li>O serie de termene prev\u0103zute de Legea Insolven\u021bei au fost extinse, precum:<ul><li>Termenul prev\u0103zut pentru satisfacerea crean\u021belor stabilite prin planul de concordat preventiv aflat \u00een executare la data intr\u0103rii \u00een vigoare a Legii M\u0103surilor \u00een Starea de Alert\u0103 a fost extins cu dou\u0103 luni;<\/li><li>Perioada de observa\u021bie (i.e. perioada dintre data deschiderii procedurii de insolven\u021b\u0103 \u0219i data confirm\u0103rii planului de reorganizare) care se afl\u0103 \u00een derulare la data intr\u0103rii \u00een vigoare a Legii M\u0103surilor \u00een Starea de Alert\u0103 a fost extins\u0103 cu trei luni;<\/li><li>Perioada pentru implementarea planului de reorganizare care se afl\u0103 \u00een executare la data intr\u0103rii \u00een vigoare a Legii M\u0103surilor \u00een Starea de Alert\u0103 a fost extins\u0103 cu dou\u0103 luni.<\/li><\/ul><\/li><\/ul><p style=\"padding-left: 40px;\">\u00cen situa\u021bia \u00een care debitorul aflat \u00een stare de insolven\u021b\u0103 \u0219i-a \u00eentrerupt par\u021bial sau total activitatea ca urmare a m\u0103surilor adoptate pe durata st\u0103rii de urgen\u021b\u0103\/st\u0103rii de alert\u0103, aceast\u0103 perioad\u0103 poate fi extins\u0103, f\u0103r\u0103 a dep\u0103\u0219i \u00eens\u0103 o durat\u0103 total\u0103 de cinci ani ori, alternativ, debitorul poate solicita judec\u0103torului sindic suspendarea execut\u0103rii planului de reorganizare pentru o perioad\u0103 ce nu poate dep\u0103\u0219i dou\u0103 luni.<\/p><p>\u00a0<\/p><p><em>*Aceast\u0103 ePublica\u021bie este furnizat\u0103 de Radu T\u0103r\u0103cil\u0103 P\u0103durari Retevoescu SCA \u00een scop exclusiv de informare \u0219i nu reprezint\u0103 asisten\u021b\u0103 juridic\u0103 sau o ofert\u0103 pentru acordarea de asisten\u021b\u0103 juridic\u0103.
